Constitutional law

Constitutional law is a branch of law that contains clear rules on the activities of state institutions, their interaction with individuals and legal entities, and the implementation of their fundamental rights and obligations to society. Our company employs experienced specialists whose activities are aimed at resolving issues in the constitutional field, in particular during the consideration of cases and direct litigation.

Services of specialists in constitutional law

Our team includes lawyers who handle cases in constitutional law concerning:

  • Political system of the state, relationships between citizens and the government, and between various state bodies.
  • Legal status (rights and obligations) of citizens, state bodies and officials, and mechanisms for their implementation.
  • Registration, existence, and activities of political parties.
  • Implementation and interaction of legislative, executive, and judicial branches of power.
  • Division of powers between state and local self-government bodies, as well as autonomous formations within Ukraine.
  • Implementation of political, economic, and other rights of individuals and legal entities, competence, and powers of governing subjects.
  • Application of international law norms in Ukraine.
  • Lawmaking process, prospects for legislative development.

Despite its foundational nature, constitutional law has extensive practical application and public significance. Disputes in this area are caused by the adoption of legislative and sub-legislative norms affecting an undefined circle of individuals. Our experts resolve issues such as violation of citizens’ electoral rights, misuse of administrative resources, and exceeding the powers of local self-government and state bodies.

Assistance in the constitutional and legal sphere is not always associated with a dispute and can be part of positive relations. For example, we examine draft decisions for their compliance with the fundamental law of the state, provide advice on general compliance with the constitutional procedure for reforms, the creation of new government bodies, and the division of powers between them.

What our assistance in the constitutional
and legal field looks like

The relations between the state and citizens (legal entities and individuals), as well as governmental entities, are the main focus of constitutional law. Most often, we are approached by clients who face massive violations of rights, abuse of power by various government agencies, obstruction of legitimate activities, and refusal to comply with the Constitution of Ukraine as an act of direct action. The detailed algorithm of assistance we provide is as follows:
The lawyer studies the specific issue and finds ways to resolve it within the framework of constitutional legislation.
The specialist draws a conclusion on the list of rights and norms that are violated in a particular case.
The expert sends legal requests to relevant institutions for necessary information and documents.
The lawyer develops a strategy to defend public interests or justify a public legal position.
The specialist prepares appeals to the Authorized Representative of the Verkhovna Rada and/or lawsuits to the Administrative, Constitutional or European Court of Human Rights (depending on the specific situation).
The expert represents the client's interests during the court case, challenging legislative and regulatory acts in higher jurisdictions.
Knowledge of the Constitution of Ukraine is not enough to assess the prospects for resolving a dispute in the client's favor. In most cases, it is better for clients to turn to experienced lawyers who are familiar with cases in the Constitutional Court and the European Court of Human Rights and who are able to refer to national and international conventions ratified by Ukraine. We have the relevant specialists in our staff who are familiar with such sources of law.
